1. Introduction

Welcome to Elite Renovations. These Terms of Service ("Terms") govern your use of our website and services provided by Elite Renovations ("Company," "we," "us," or "our"). By accessing our website at eliterenovations.com or engaging our renovation services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services or website.

2. Services Description

Elite Renovations provides premium turnkey renovation services for luxury homes in Accra, Ghana. Our services include architectural design, interior design, construction management, and smart home integration. The specific details, scope, timeline, and cost of each project will be outlined in individual contracts signed with clients.

3. Client Responsibilities

As a client, you are responsible for:

  • Providing accurate and complete information regarding your property and renovation requirements
  • Securing necessary permits and approvals from relevant authorities, unless specifically agreed that we will handle this
  • Providing timely feedback and approvals during the design and construction process
  • Making payments according to the agreed schedule
  • Ensuring site access for our team during scheduled working hours
  • Notifying us promptly of any concerns or issues during the renovation process

4. Payment Terms

Payment terms will be specified in your individual contract. Typically, our payment structure includes:

  • Initial deposit to secure our services and begin the design process (30% of estimated project cost)
  • Progress payments at key project milestones (50% distributed across milestones)
  • Final payment upon project completion and client approval (20% of total project cost)

All payments are non-refundable unless otherwise specified in your contract. Late payments may result in project delays and additional fees.

5. Project Timeline and Delays

While we strive to complete all projects according to the timeline specified in your contract, certain factors beyond our control may cause delays, including:

  • Adverse weather conditions affecting construction
  • Unforeseen structural issues discovered during renovation
  • Delayed material deliveries from suppliers
  • Changes to the project scope requested by the client
  • Permit approval delays from local authorities

In the event of such delays, we will communicate promptly and work to minimize impact on the overall project timeline.

6. Changes and Modifications

Any changes to the agreed project scope, design, or materials must be submitted in writing and may affect the project timeline and cost. A Change Order document will be issued detailing the modifications and associated costs, which must be approved and signed before implementation.

7. Warranty and Quality Assurance

Elite Renovations provides a warranty on workmanship for a period of 12 months from project completion. This warranty covers defects in installation and craftsmanship. It does not cover:

  • Normal wear and tear
  • Damage caused by improper use or maintenance
  • Issues arising from client-supplied materials
  • Damage from natural disasters or other force majeure events

Manufacturer warranties for appliances, fixtures, and other materials will be passed on to the client and are subject to the manufacturer's terms.

8. Intellectual Property

All designs, plans, and renderings created by Elite Renovations remain our intellectual property. While you may use these designs for your renovated property, they may not be reproduced, shared, or implemented elsewhere without our written permission. We reserve the right to photograph completed projects for our portfolio, marketing materials, and publications, with appropriate discretion regarding client privacy.

9. Termination

Either party may terminate the contract under circumstances specified in your individual agreement. Early termination may result in:

  • Retention of payments for services already rendered
  • Additional fees to cover costs incurred
  • Transfer of materials already purchased

10. Limitation of Liability

Elite Renovations' liability is limited to the total value of your renovation contract. We are not liable for indirect, incidental, special, or consequential damages. We maintain comprehensive insurance coverage for our operations, but recommend clients maintain appropriate property insurance throughout the renovation process.

11. Force Majeure

Neither party shall be held liable for failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, civil unrest, or government restrictions. In such cases, project timelines will be adjusted accordingly without penalty.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Ghana. Any disputes arising from our services shall first be addressed through good-faith negotiation between parties. If a resolution cannot be reached, the matter will proceed to mediation and, if necessary, arbitration in Accra, Ghana, according to the rules of the Ghana Arbitration Centre.

13. Privacy Policy

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Amendments to Terms

Elite Renovations reserves the right to update these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after any changes indicates your acceptance of the revised Terms.
